23XI Racing and Front Row Motorsports have opened an antitrust lawsuit against NASCAR. The teams are seeking more favorable terms regarding charter agreements.

Recently, the judge ruled that both teams will be allowed to run as charter teams, while the lawsuit is ongoing. The court also approved Front Row Motorsports’ purchase of a third charter.
NASCAR teams will race with charters while lawsuit ongoing
Today, NASCAR asked the judge to dismiss the case. They also asked that both teams place money in a bond, the case that charter rulings are reversed.
Judge Bell has ruled that NASCAR’s motion to dismiss the case has been denied. NASCAR’s request for bond has also been denied.

The judge opened via court documents, “What is the actual evidence and how does it inform a correct legal conclusion?”
“These questions cannot be determined on motions to dismiss in this action, where Plaintiffs have sufficiently alleged one or more plausible antitrust claims against Defendants within the applicable period of limitations.”
“See Doc. Nos. 74, 89 (granting and reaffirming limited Preliminary Injunction based, in part, on likelihood of success on the merits.”
“Instead, the answers must be found when the parties have a full opportunity to pursue discovery of the relevant facts and then at trial, where the jury will be able to weigh the evidence and assess the credibility of the witnesses (unless the case is resolved sooner by the parties or the Court).”
“Therefore, the Court will DENY the Defendants’ Motions to Dismiss.”
NASCAR calls team lawsuit "baseless"

The teams issued a joint statement through their shared attorney:
“We are pleased with today’s decision by Judge Bell to Denny the Motions to Dismiss and Motion for Bond and look forward to presenting our case at trial,” attorney Jeffrey Kessler stated.
