23XI Racing and Front Row Motorsports won their injunction yesterday; NASCAR will appeal that ruling

23XI Racing and Front Row Motorsports have filed an anti-trust lawsuit against NASCAR. This comes after of the fifteen teams, each elected not to sign the final charter agreements.

NASCAR was intending to remove those charters and race with 32 charter teams in 2025.

Yesterday, the teams won a preliminary injunction, on an appeal. That would allow both teams to run their two charter teams in 2025, with all charter benefits as the lawsuit is oingoing.

Initially, their injunction was denied by the court. After a judge change, they won the appeal.

Additionally, each team purchased a third charter from the now defunct Stewart-Haas Racing. Those charters have not been transferred. In the injunction, the courts also stated they would allow each team to claim their 3rd charter, allowing the transfer to go through.

It was a big win for the teams. But…

NASCAR will appeal the injunction ruling

NASCAR has stated they will appeal the ruling as a whole.

Additionally, NASCAR is asking the courts to delay injunction enforcement in an emergency session. Specifically, they are asking the courts to immediately delay the transfer of the two charters purchased from SHR until the appeal can be heard and ruled on in final.

The teams have stated that the SHR charter transfers need to be completed by December 20, 2024.

Here are lines from the court documents filed today:

“NASCAR will suffer irreparable harm without a stay,” NASCAR stated in court documents.

“The Court’s decision forcing NASCAR to approve Plaintiffs’ SHR Charter transfers is not a ‘limited’ injunction for the 2025 Cup Series season.”

“Instead, it will effectively force NASCAR into a seven-to-fourteen year contractual relationship with Plaintiffs with respect to these Charters-even though Plaintiffs have not met multiple required conditions for these Charters’ assignment.”

“Moreover, it would be difficult, perhaps even impossible, to unwind these court-ordered transfers once they have occurred.”

NASCAR is requesting that the charter transfers be paused until the appeal is heard.

Update

The judge has stated that he will rule on Monday is the sale of the charters will be delayed until the appeal is final.

The appeal will be heard on January 9th, 2025.
